By accessing this website and/or purchasing from Lights Alive (hereinafter referred to as “we”, “us” or “our”), you stipulate that you have read, understand and agree to be bound by our terms of service. We may occasionally update our term of service. The latest version can always be found here.

Lights Alive will not sell or share any personal data collected by our website (including our mailing list) for any reason unless compelled by law or court order to do so.

We use a SSL (Secure Sockets Layer) certificate, which encrypts data to provide a secure connection between your browser and our website. Look for the padlock to the left of our URL (web address) in your browser. Also look for HTTPS as opposed to the normal HTTP in the address. This is further verification of a secure connection.

When making credit card payments, you will be forwarded to First Data’s website, which is also uses SSL technology for your protection. First Data is one of the largest and most respected credit card processors in the world. Lights Alive does not receive, use or store your credit card information for online purchases.

When choosing PayPal for payment, you will be redirected to PayPal’s secure site. As with credit cards, we do not collect, use or store your personal information with respect to your payments via PayPal.

If you don’t wish to enter payment information on the website, you can call us and we’ll process your card manually. You also have the option to print your order and pay by personal check or money order. Please, send no cash.

We may use cookies in order for our website to remember you, the contents of your shopping cart and/or your preferences upon your return. Cookies are tiny files stored on your equipment (computer, smart phone, tablet, etc.). Our cookies do not contain personally identifiable information. If you are not comfortable with the use of cookies, you may be able to disable their use on your equipment. Please note that, if you refuse or disable cookies, certain features and/or functions of our website may not function properly or be available to you.

It is always in your best interest to have your order shipped to a business location whenever possible as shipping rates are considerably lower. You must indicate whether the shipping location is residential or commercial when placing your order. If you choose commercial when actually sending to a residential location, you agree to pay the additional shipping costs plus any and all additional fees assessed to Lights Alive by FedEx. At our discretion, we may require a signature for delivery. Further, we may require delivery be made to the billing address.

Shortages or shipping damages must be reported within five (5) business days of receipt. We go to extraordinary efforts to assure your order is accurate and complete, but we aren’t perfect.

Products manufactured by Lights Alive are warranted against defects in materials and workmanship for a period of three (3) years from the original purchase date. Products found to be defective will be repaired or replaced at the sole discretion of Lights Alive. This limited warranty specifically excludes equipment that has been modified or used in a manner inconsistent with its labeling, specifications or instructions. Also excluded are normal wear and tear, expendable supplies (light bulbs, batteries, cables, etc.), water damage, power line irregularities or acts of God.

Manufacturer’s warranties apply on products not manufactured by Lights Alive.

To obtain warranty service, you should first contact Lights Alive for technical support. In most cases the problem can be resolved over the phone or by email. If a product is determined to be defective, you will be emailed a Return Authorization form. Once the form has been completed, carefully package the defective item, the completed form and your check or money order for return shipping (see RA form for shipping costs). Your return authorization number should be clearly visible on the top of the package. It is highly recommend that you insure your package as Lights Alive is not responsible for items lost, stolen or damaged in transit. Upon receipt, we will promptly analyze your item and advise you of our findings. If it is a warranty issue, it will be repaired (or replaced) and returned promptly. If the problem is not covered by warranty, we will advise and provide you with the appropriate options. You are responsible for shipping to and from the Lights Alive facility.

We will gladly accept returns of unopened stock items within 15-days from the date of sale, except as noted below. Special orders are NCNR (non-cancellable and non-returnable). Opened items may be subject to a restocking fee of up to 20%. Used equipment may only be returned for repairs. Due to the holiday nature of our products, returns are not accepted after October 15.

Acceptable forms of payment are Master Card, Visa, Discover, American Express, PayPal, money order or check. You agree to pay for all products and services ordered plus reasonable attorney fees, court costs, and other collection costs resulting from PayPal disputes, reversed credit card charges or checks returned for any reason including, but not limited to, account closures, stop payment or insufficient funds. A service charge of 1.5% per month will be added to all past due accounts.

In order to protect you and to keep prices reasonable, our credit card payment gateway is very sensitive to potential fraud and will reject cards that are questionable. Please be sure that the billing address you enter exactly matches your credit card statement address. We do reserve the right to refuse any order that appears (in our opinion) to be fraudulent. Don’t hesitate to contact us if we may be of assistance.

This transaction will be governed by the laws of the state of Indiana. In the unlikely event of a dispute, all claims will be filed in the courts of Hendricks County, Indiana.

Any advice, technical or otherwise, is offered free of charge as a courtesy to our customer(s). Lights Alive shall have no responsibility or liability for the content or use of such information. Electrical devices should be installed by qualified personnel in accordance with all local, state and national codes. When in doubt, always consult with a licensed electrician.

All products sold by Lights Alive are for entertainment purposes only and must never be used for critical applications where personal injury or property damage could occur. By using these products, you understand and agree that Lights Alive is not responsible for damages, whether real or consequential, direct or indirect, even if they are a result of our negligence. To the extent allowed by law, the remedies provided by our Limited Warranty are your sole and exclusive remedy. No other warranty is expressed or implied.

Lights Alive brand products are designed and manufactured in the United States from components of various origins.

You agree not to copy or reverse engineer or otherwise modify any hardware, software or firmware designed for or by Lights Alive without our express written permission.
